Club Constitution
CLUB CONSTITUTION
Preamble
Stansted Hall Cricket Club is an unincorporated association with unlimited liability. As a consequence the Club will not engage in any commercial trading activity and will maintain adequate insurance cover for public liability and other appropriate insurable risks for the benefit of the Club assets and the members. The members are those categories of person specified in paragraph 11 of this constitution.
- That the Club shall be known as Stansted Hall Cricket Club.
- That it shall be affiliated to the England and Wales Cricket Board and to any other organisation deemed beneficial to its interests.
- That the Club shall provide opportunities for all members to participate in playing cricket. Membership of the Club shall be open to all persons irrespective of ethnic origin, nationality, sexual orientation, religion or beliefs; or of age, sex or disability except as a necessary consequence of the requirements of cricket as a particular sport.
- That its aims and objectives shall be; a) To offer coaching and competitive opportunities in cricket. b) To promote the Club within the local community and cricket. c) To manage the Club and its services in such a way that all present and future members receive fair and equal treatment. d) To ensure a duty of care to all members of the Club by adopting and implementing the ECB ’Safe Hands-Welfare of Young People in Cricket’ Policy and any future versions of the Policy. e) To entertain bona fide guests after matches.
- That the Club’s Conduct and Child Protection Policy together with the Club’s Equity Policy Statement shall be enshrined as part of these rules.
- That the Officers of the Club shall be the Chairperson, Vice-Chairperson, Treasurer, Secretary, Social Secretary, Press Secretary, Fixture Secretary, Youth Development Officer, Child Protection Officer, Cricket Club Coaching Coordinator, the Captains and the Vice-Captains, each to be elected annually.
- That the management of the Club shall be vested in the Committee, consisting in the Officers of the Club each to be elected annually and such other ad-hoc co-opted members as decided by the Committee. The Committee will be responsible for adopting new policy, codes of conduct and rules that affect the organisation of the club. The Committee will be responsible for disciplinary hearings of members who infringe the club rules/ regulations/ constitution. Any such disciplinary hearing will conform to rules of natural justice and will be conducted in accordance with the provisions of paragraph 20 of this Constitution. The Committee will be responsible for taking any reasonable action including suspension or appropriate other sanction following such hearings.
- The quorum for committee meetings shall be six committee members present in person. The Committee to meet at least eight times annually and at such other times as necessary. In the absence of the Chairman at any Committee meeting, the Committee shall appoint a Chairman for the duration of that meeting. The Committee shall have the power to fill any vacancy among the Officers of the Club and also to co-opt. The Committee shall have the power to form sub-committees as and when required.
- That the Committee shall have the power to elect a President of the Club, who may attend committee meetings and have full voting powers.
- That membership shall consist of the officers and members of the club. All members will be subject to the regulations of the constitution and by joining the club will be deemed to accept the regulations and codes of conduct that the club has adopted.
- That membership shall be available in the following categories: Adult playing member (over 18); Junior playing member (under 18 on May 1st); Family Member; Honorary member; Life member.
That under the rules of the Club persons may not be admitted to membership, or be admitted, as candidates for membership, to any of the privileges of membership without an interval of at least two days between their nomination for membership and their admission.
That under the rules of the Club, those becoming members without prior nomination or application may not be admitted to the privileges of membership without an interval of at least two days between their becoming members and their admission.
- That membership fees and match fees will be set annually and agreed at the Annual General Meeting (AGM).
- That membership fees will be paid in full by June 30th in the current season. Any member failing to pay the fee within this time constraint will not be considered for playing selection in any of the club teams until this fee is paid in full. No non-member shall be allowed to take part in any game if there are a sufficient number of members wishing to play except if the Committee deem it necessary to give a prospective new member a trial.
- That the club Treasurer will be responsible for the finances of the club. All club monies will be banked in an account held in the name of Stansted Hall Cricket Club. The financial year of the club will end on October 31st. The Treasurer at the AGM will present a statement of Annual Accounts. Any cheques drawn against club funds shall carry the signatures of the Treasurer plus up to two other officers.
- That the AGM will be held in November, to elect Officers, the Club Committee, to hear and approve the Club accounts and to dispose of any other business connected with the Club. That not less than 21 days notice of such a meeting shall be sent to Officers and members by the Club Secretary. Nominations for Officers of the Committee will be sent, in writing, to the Secretary signed by a proposer and seconder not less than 7 days prior to the AGM. The nominee’s consent must previously have been obtained. In the event of there being insufficient nominations in accordance with the above directive, nominations for any remaining vacancies can, at the discretion of the Chairman, be received at the AGM itself.
- That all members have the right to vote at the AGM.
- That the quorum for the AGM will be one-fifth of those entitled to vote at such a meeting.
- That the Committee has the right to call Extraordinary General Meetings (EGMs) outside the AGM. Procedures for EGMs will be the same as for the AGM.
- The Club shall comply with the terms of the License to play cricket granted by the owner of Stansted House (The Landlord).
- Members their bona fide guests and visiting members of other cricket clubs will be allowed to purchase liquor in the pavilion between 6.00pm and 9.30pm on the days when matches are played at home. These hours may be modified (within permitted licensing hours) in exceptional circumstances with the permission of the owner of Stansted House. A visitor’s book will be kept at the Club’s premises and signed by both members and their guests. The purchase and supply of liquor will be managed by a sub Committee of the Club Committee. All income from the sale of liquor will be retained in the Club. No member may introduce more than four guests in one day and no person shall be permitted as a guest at the Club on more than five times in the year without becoming a member of the Club. All members, guests, and visitors will behave in an orderly manner at all times. Any member guest or visitor behaving in an unruly manner will be asked to leave. The maximum number of people to whom alcohol will be served on any one day will be 50. No loud music will be played on the premises. Only Club members over the age of 18 will serve alcohol. Alcohol cannot be served to anyone under the age of 18 years old.
- All complaints regarding the behaviour of members should be submitted in writing to the Secretary. The Committee will meet to hear complaints within 7 days of a complaint being lodged. The Committee has the power to take appropriate disciplinary action including the termination of membership. The outcome of a disciplinary hearing should be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within 3 days of the hearing. There will be the right of appeal to the Committee following disciplinary action being announced. The Committee should consider the appeal within 7 days of the Secretary receiving the appeal.
- That a resolution to dissolve the Club shall only be tabled at the AGM or an EGM. That a vote in favour by three-quarters of the membership shall be necessary for it to succeed. In the event of dissolution, any remaining assets of the club shall be given or transferred to one or more of the following; a) a recognised charitable organisation having objects similar to those of the Club; b) another club with similar sports purposes, and/or c) the Club’s national governing body for use by them for related community sports.
- That this Constitution will only be amended or replaced through agreement by majority vote at an AGM or EGM.
- That the Committee of Stansted Hall Cricket Club shall be empowered to deal with any matter not specifically provided for in the Rules or this Constitution.
- That Stansted Hall Cricket Club hereby adopts and accepts this Constitution as a current operating guide regulating the action of its members.
